The Essentials of Guardianship
Guardianship services become necessary for a minor child without legal parents or for adults who "lack the capacity to manage such person's estate, or to meet essential needs for physical health, safety, or welfare, and who are in need of a Guardian or a Conservator, or both." KSA 59-3051(a).
Individuals who are unable to manage their own independent living need a Legal Guardian. Those who require a Legal Guardian never surrender their rights to make choices or be involved in their daily care decisions. The choice of the Ward is always an important consideration.

Individuals who have a Guardian are referred to by the court as Wards. A Ward is an individual who has become a Ward of the court because of his or her need for Legal protection. The assigned Guardian of the Ward is responsible to the court. Kansas statutes provide clear standards for each Guardian as they serve to meet the needs of the Ward.
Advocacy is the heart of an excellent Guardian. One cannot advocate for another human being without personally finding out what the needs and desires of the person are.
The Law and Spirit of the Law Requires a Personal Relationship
Legal guardians are required by law to become and remain personally acquainted with the Ward, the spouse of the ward, and other interested persons associated with the Ward and who are knowledgeable about the Ward, the Ward's needs, and the Ward responsibilities.
Responsibilities of a Guardian
A Guardian shall exercise authority only as necessitated by the Ward's limitations.
A Guardian shall encourage the Ward to act on the Ward's own behalf to the extent the ward is able to do so.
A Guardian shall encourage the ward to develop or regain the skills and abilities necessary to meet the Ward's own essential needs and to otherwise manage the Ward's own affairs.
In making decisions on behalf of the Ward, a Guardian shall consider the expressed desires and personal values of the Ward to the extent known to the Guardian.
A Guardian shall strive to ensure that the personal, civil, and human rights of the Ward are protected.
A Guardian shall at all times act in the best interests of the Ward and shall exercise reasonable care, diligence, and prudence. KSA 59-3075(2).
